1. About these terms

These Terms of Service govern your access to thebeachlet.com and the Beachlet storefront, including its content, custom bracelet builder, products, and related services. In these terms, "Beachlet," "we," "us," and "our" refer to the business operating the store.

By using the storefront or placing an order, you agree to these terms. If you do not agree, please do not use the services. Our Privacy Policy explains how personal information is handled. Our Shipping Policy and Refund Policy provide the details for fulfillment and returns.

2. Eligibility and accounts

You must be legally able to enter into a purchase agreement in your place of residence or use the services with the involvement of a parent or guardian where permitted. Provide accurate contact, billing, and delivery information and keep it up to date.

You are responsible for keeping account access secure and for activity you authorize through your account. Notify us if you believe an account or order has been accessed without permission.

3. Product descriptions and availability

We aim to show products and options accurately. Screen settings, lighting, natural sand, and the handmade or assembled nature of a bracelet can cause reasonable differences in color, texture, and appearance. Product photos and builder previews are visual references and do not guarantee an exact screen-to-product match.

Product availability, options, prices, and descriptions can change. The information presented for your purchase at checkout applies to that order, subject to correction of an error and applicable law.

4. Custom bracelet orders

Review the selected beach, sand, cord colors, knot, quantity, and any other custom options before adding a bracelet to your bag and again before completing checkout. The builder can generate a preview image that is attached to the cart and order as a reference for the selected configuration.

Custom products are generally excluded from change-of-mind returns under our Refund Policy. This does not limit remedies for an item that is damaged, defective, incorrect, or otherwise covered by mandatory consumer protections.

5. Orders and payment

Placing an order is a request to purchase the products shown in checkout. An automated order confirmation acknowledges receipt of the order. We may need to decline or cancel an order because an item is unavailable, payment cannot be verified, information is incomplete, an error affects the order, or there is a reasonable concern about fraud or misuse.

If an order is canceled after payment has been collected, we will arrange the appropriate refund. Payment is processed through Shopify checkout and the payment providers made available there. You authorize the charge for the order total you approve at checkout.

6. Prices, taxes, and promotions

Prices, available currencies, shipping charges, and taxes are shown in the storefront or at checkout as applicable. Check the final total before submitting an order. International orders may involve additional charges as explained in our Shipping Policy.

Discounts and special offers are subject to their stated conditions, eligibility, availability, and dates. Offers cannot be combined unless their conditions permit it. A pricing or description error does not require us to fulfill an order on terms that are plainly incorrect, subject to applicable law and an appropriate refund where payment has been collected.

7. Shipping, returns, and cancellations

Processing, delivery estimates, tracking, and shipment issues are described in our Shipping Policy. Return windows, exclusions, approval, and refund processing are described in our Refund Policy.

Contact us promptly about a change or cancellation. We cannot guarantee a change after preparation, custom production, or shipment has begun. These terms do not remove cancellation or other rights that apply under mandatory law.

8. Acceptable use

Do not use the storefront for unlawful activity, payment fraud, impersonation, harassment, or infringement of another person's rights. Do not introduce malicious code, interfere with checkout or security, bypass access controls, or use the site in a way that disrupts its availability.

We may limit access or refuse an order where reasonably necessary to address misuse, protect customers, or comply with applicable requirements.

9. Content and intellectual property

The Beachlet name, branding, designs, photos, text, builder materials, and other storefront content are owned by Beachlet or used with permission. Access to the site does not transfer ownership or grant permission to reproduce or commercially exploit that content beyond uses allowed by law.

You retain rights in original content you submit. If you submit a review, photo, or other content for publication, you confirm that you have the necessary rights and permissions. We may use that submission for the purpose for which you supplied it, subject to any additional permission or terms that apply.

10. Third-party services

Shopify and other providers supply services such as payment processing, account features, delivery, and support tools. Their services may be subject to separate terms and privacy policies. Links to third-party websites do not make Beachlet responsible for those websites' content or practices.

11. Website availability and limitations

We work to keep the storefront accurate and available, but errors, interruptions, and maintenance can occur. To the extent permitted by applicable law, the website and its informational tools are provided on an "as available" basis without a promise of uninterrupted or error-free operation.

Nothing in these terms excludes a mandatory product warranty, consumer guarantee, or other right or remedy that cannot lawfully be excluded. Product-related issues are handled under the applicable policies and law.

12. Responsibility and applicable law

To the extent permitted by applicable law, Beachlet is not responsible for indirect or consequential losses arising from use of the storefront, including losses caused by unauthorized third-party activity or service interruptions outside our reasonable control. This does not exclude liability where exclusion is prohibited by law.

These terms are governed by applicable laws of the United States. Mandatory consumer protections that apply where you live are not displaced by these terms. No provision is intended to waive rights that cannot lawfully be waived.

13. Changes to these terms

We may update these terms by posting a revised version with an updated date. Changes apply prospectively and do not retroactively change an existing order's agreed terms unless permitted by law or agreed with you. We will provide additional notice where required.

If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not by itself waive it on another.
